Hi, was at my local BP today, filling up, went to pay and thier eftpos machine was down, i ony had card, they said they didnt have any method of payment for eftpos, No cash, I told them i don't have any cash on me, and i tell what are we going todo, and he says to leave me credit card with him. i tell him no. he then threatens to call the police becuase i was refusing to pay for petrol :O |

Well that's quite unfair.. My parents were at a Mobil that only took cash and was pre paid..all my mum had was her credit card...the companies should think about these things.. |

They should have told you or had a notice before you filled up. As if everyone pays in cash, especially with petrol where it is usually at least $50+ a tank!! I would have left driver's licence details etc, but certainly no credit card details. Shifty kunts...what did you end up doing?

you should have told them to bring out the manual click-clacker. if you accpet cards,you have to have a manual machine as well as the electronic setup for just that eventuality. Justin... |

My work use to have only the old click clacker one, but once we got the new machine installed they got rid of the old one, so if it's down...it's down, that's all.. But that's a tad strange that hey expected you to leave your credit card details o_o seems a tad shifty really... Whenever that's happend to me at a servo before they were more than happy with my Drivers Lisc. details & a contact number, and told me just to come back before the end of the day and pay for the fuel, never had any weird demands like that o_o... Did you actually give them your credit card details in the end??

He took my phone number and address and scanned my drivers liscence. He said he will ring me and inform me a time i can come in . They should of had the clicky one, with what fergo said , legally they should have one. Ohwell, Complaints ahoy. |

Justin... yeh just like tyhe olden days, i went servo one day and same story, i just ended up filling for old eftpos transaction paper works |

There should've been some sort of sign notifying you that EFTPOS facilities weren't available so if you didn't have cash you wouldn't fill up. Otherwise, I doubt they could really call the cops and get you charged with theft, unless you left without leaving any details (which you obviously didn't). I wouldn't have a clue how the law stands in this situation, but your licence and credit card is your property (well, the RTA's and the bank's) so they have no right to demand you leave it with them. If you left your details and go back and pay as soon as humanly possible, I'm sure there won't be an issue at all. I'm pretty sure that people who don't have the money to pay for petrol - in most situations - can leave their details and come back and pay within a reasonable time frame ... if they don't, then I'm sure the Service Station would report it as a theft. PS: We don't have the old manual method for cards at work, so if our system is down, we're screwed. That said though, in years of working there it's never been an issue, but we have multiple EFTPOS machines and phone lines to choose from. |

I don't think they'd demand you leave your lisc. WITH them, but more of get your details down off it o_o... |

Unless he had a sign up (in clear view to anybody about to use a pump) saying that you couldn't use EFTPOS, a magistrate would most likely rule that you should pay as soon as is reasonably possible. This might include going to an ATM that day unless you had important prior arrangements. That's what I would expect a magistrate to say, anyhow. PS I have a law degree, so this is not just a guess. |

we had a visit from the cops one day who wanted to speak to my brother for an accused 'failure to pay for petrol' The thing was, he did pay for petrol, because at the time of night he filled up, the servo is 'pay before you pump' and the pumps dont activate until the attendant flips the switch. I think its just dodgy owners scamming anyone they can remotely get away with. |
