Well originally I think the police were going to let it slide, but I kind of didn't let it go, so they took another look at the situation. Really if you think about it for a second it was fairly obvious that I wouldn't have tried turning there if I had a choice.

Yeah I also think the insurance company are dragging their feet because they dont want to pay.

Good news :) spoke with insurance company today and they are going to pay me out. The other guy has already paid his excess ,so it is a case of organising the assessor to have a look at the car.

Guess it all comes down to what sort of deal we can negotiate as to what will be for sale... probably a couple of weeks before I can get it accessed with Christmas in between.

Just be genuine about it with the assessor... I had a similar situation a year ago but i wasnt insured. Luckily the other person's insurance covered both cars.... I told them I had a loan owing on the car and wanted to keep it from the moment the assessor came out. They paid out the amount of my loan and let me keep the car with almost 10k of mods for 500 bucks.
The acco wasnt your fault and your getting disadvantaged in losing your car and not having transport. Youll be fine, just make sure you tell the assesor the facts and be as genuine as possible.

I was genuine and straight up with me but it didnt get me very far. They reakon it was worth $15k before the smash - wreck cost.

Anyway we came to a more respectable figure and they are going to pay me out :(

Yeah a straight payout wasn't even an option. So I am going to try strip everything I can off it and sell the body to Sims metal for scrap.

Sounds like the best result you could expect under the circumstances.

I had an old guy pull out in front of me and prop, that's how I lost my first Silvia. Good luck on the next build.
