 Post subject: Defect Question

Just a questions, if you were involved in an accident and you were not at fault, but your car is defected,defectable, would that change who is at fault? cause ive heard things like if you have cut springs which is a defect and ur involved in an accident which is not ur fault, you will still be at fault for having a defect.

they are two different senarios

If you have a defect on the car and are still driving it past the date you had set to clear it, then I think you'd be in trouble as you weren't supposed to be on the road.

If you are driving a car that could be defected, then I don't think they can automatically shift the blame onto you for having a defectable car! Unless that defect is negative to the cars performance I suppose.

When i had my crash... i wasn't at fault and my car was extremely defectable (and the police knew it) but it was still the other drivers fault, no question about it.

I was a bit worried that their insurer wouldn't pay up because it was so illegal.. but they did, and they covered the total costs of what it cost me to build the car too.

the only time insurance wont pay up is if the illegal mod was the cause of the accident, if the mod isnt to blame then your generally in the clear :)

Abit off-topic here,

But me and phu were discussing this earlier;

Question; Say you had a car with stock suspension with a full load of kiwis,

and the car would be sitting just below the 100mm mark, and the

cops go to pull you over, is that a defect?


Bit stupid.. but yeah.

if they do pull you over for it being too low as long as the car is above 100mm with no one in it, your fine :)

lol interesting "as long as theres no one in it" hhmm...damn i had a full car load once and got defected becuase the lowest part of my car was 95mm high. that sux should of told everyone to get out

A defect that would make people less aware of you're presence / location in a lane could see you ending up at fault (like, smoked tail lights when someone runs up the back of you...) Ride height I wouldn't think so...

It's not stupid its irrelevent cause there is no way you could fit kiwis in the back of a silvia/180 :P
