Dear all,

Maybe I should request this to be attached to Mandys subject. I was with my gf driving from the northern beaches to the CBD, and was just entering the harbour bridge, when this red commodore kept on changing lanes and he didnt check his blind spot, so he ended up hitting me and almost rammed me to a pole.

His car plates was from queensland, license from queensland and he alleges that he still lives in queensland and apparently he comes to sydney because of the hospital for his wife. Bad news or good news whatever happens he didnt have insurance.

I am sending a quote (2) to him tomorrow and its about roughly $3 700 to 4 200. Keep u guys informed on what happens. O yeah the car wasnt stolen and the plate did match with the queesland address.

Bad news also was my rego is almost expired......... :cry:

They all drive under the speed limit, run red lights and do u-turns everywhere.

Cant expect too much when u even see 5 ot 6 year old kids driving in cars and shooting things!!! :lol:

But really the thing that annpyed me was the fact this happened before me going on holidays which is going to put off my holiday and also it has made me gf get scared when she is in the car with me. She has been in the car twice when I was driving. I can safetly say it wasnt my fault for both times but still...... I would hate to have to buy silvia III........

Im used to my gf getting scared when she's in the car, lol I just ignore it.

Hope the guy pays up, the police would have to of turned up for a crash like that?

How do they get people with no insurance to pay up? Is it just hoping that their honest or scared from the cops?

Because there was no toll truck required and no one needed to go to the hospital, they consider it a minor incident. The guy better pay up because I would take it further and he is in no position to haggle or bargain.

The reason why he didnt have insurance is he said he recntly acquired the car. Still stupid not to have one if your interstate. At least his number works.......

what about your insurance? will they follow up for you?

if not,put the legal side of it in motion NOW. you've sent him quotes,now send him a letter giving him 7days to agree to one of the quotes,and pay the repairer.
after that,get a solicitor to follow it up for you and take it to the local court.

If you suspect he's lying about living here, I'd do everything you can to cover yourself because, no doubt he'll start lying down the track aswell

trying to give him the benfit of the doubt and pay in cash because I can get the repirs done cheaper by a mate who would charge me at mates price and also he doesnt want it to go through the insurance company because of his premiums and so forth.

I called him last night and the son of a bitch (sorry wash my mouth with soap) straight away when I told him the price wanted to trim $1000 off the quote!!! His whole attiude was as if it was my fault. I informed him that I have two witnesses to the accident and the poilce would cxharge him for neg driving and the inurance company would get the money either way as well as charge him for non- compliance. Made some bullshit so he wouldnt try to worm him way out of it.

What do u guys think of sending him the 3rd party unisured forms. Saying he has to write a statemenet to say he was uninsured at the time and the inusrance comapony chase him up? Would that be a better option?

I reckon you send him a legal letter spelling it all out,and give him a deadline to pay up. if he doesn't meet it,go straight to court. f**k him.
if he's going to stuff you around,pay him back in kind. make him pay,and pay up big.

Don't give them any leeway, and don't accept any bullshit. If you or your panelbeater don't have a cheque in hand within a few days of you delivering the three quotes, go after him.

I had a similar experience a few months ago (not a bad accident like yours though, just a minor rear ender) and the prick was uninsured (although supposedly on a cover note). At the time he said he'd pay up, but his story changed every time I spoke to him after that. Eventually it was "fuck you, take me to court". I could have saved myself at least 3 weeks of bullshit by just setting my insurance company on him in the first place.

Success!!! Got the cheaque and it was after one of my mate from a legal firm called him and said to him to either pay up or suffer more!!! THe cheque is getting processed through and going to take it to the panal beaters to get it fixed and repsrayed after I come back from holiday.
