 Post subject: Not at fault acco claim!

Bloody a new BMW red-p plater T-Boned my car the other week (full side swipe) and its been written off $15k to fix stuff.

Fair enought the guy got a claim number to me the next day but GIO assessors wreckon that a '98 s14a is worth only $11k market value todate. i laughed in his face n told him i want atleast $23k with the S14.5 conv and all mods (fair price, spent a lot more); he replied that i devalued my car and came upto $12.5k payout figure (minus $2.5k to buy it back) pulling this figure out of thin air just coz i told him where to stick it.

By this time i was furious n told him to come back with a better offer. I went home n got 40 cars off the net 4sale average price being approx$19.4k and rang him back and said here's evidence that this is the min payout figure as i need to replace the car, he came back with bull sh*t and said in that case he'll fix it(cos he thinks he'll get it done cheaper than $15k), so i said i would see a solicitor to get on his ass coz he's stressing me out n taking time out of my work. Still waiting for the solicitor to call me back i ring GIO n tell them that there assesor is dodgy and stuffing me around she refered me to a area manager n he said he'd look into it n get back to me next week.

mean while i'm on foot because i can't hire a car until i'm 21 which is chrissy day, but intitled to 1(how nice, i just cant get it yet)

well sorry for wasting 5min from your day but its stuffed my chrissy right up the wall



What should i do??
anyone been in a similar situation??

If he can do a decent reliable S14 with S15 front for 11.5K, I am there immediately, and I am sure we can do a roaring group buy for that price!!!

nope but than they would only pay me out what i bought it for than ($17k) but i've spent over 10 on it mods wise, so it could work out better..
only 96k on the clock aswell not too bad for a s14.
prob buy it back at the end of it all for pure drift :roll:

IMO fight it, also speak to the insurance board (or whatever they are called) because 11k for an S14 is a pittance. thats like a slap in the face and you shouldnt take it. you were no at fault, i think you should be compensated in full.

but please dont attack the assesor, you original thread is borderline me editing it, i believe she would be only doing her job. GIO would be who i would be after

seeking legal advice is a great start and a smart move.

I think you've done the right thing.

They are trying to screw you, no doubt, because the car is modifed and they are using it as an excuse.

By doing your research and then making a complaint to GIO and the solicitor i think you are right on the money. There's not much more you can do at this stage.

The thing is, if you call up your insurer and tell them you had a not-at-fault accident, their assessor will review the car. Since you have the details of the person at fault and got them dead to rights, its not in your insurer's best interests to stiff you on it. It costs them nothing, and fixing your car up is good customer service on their part (unless its the same insurer, of course).

So you get your guys to assess it, fix it (and your assessor / choice of repairer will have a field day on the car since you can bill someone else) and then your insurance company goes to rape the other driver's insurance company instead.

no the lady i was talking to was GIO... i was nice to her.
Its the assessor from GIO who's stiring the crap.
I had the damage assessed already thats not the thing there saying that for $11k i can replace it because thats around the carsales market value.

thats why i gave him all advertisments for the week for a S14 (about 40 adds) and the mean price was about $19.4k

I was very polite to GIO

did you let them know you are seeking legal advice? sometimes they back down with the threat, also, if he/she is cheap enough. have the solicitor call GIO on your behalf, they know what to say and how to say it in right way. trust me, i married into a family of lawyers and i cant win anything there :P

yer i did that on friday last week when i gave them the advertisments. i said that if he won't come to a reasonable offer my solicitor will be incontact with him this week because i'm fed up with the games.

like how could he go straight from $10k to $12.5k from me just saying its not good enough; he's just pulling figures from his ass. But there must be some suckers out there who take the $10k thinking thats all they would get.

lol they called me today and came up to $14k but i'm still not happy, so he said that he would fix it then but rather than replacing the pannels they would repair them. i said no and that it wouldn't be the same and he has to come up witha a better payout figure.
So he's sending the car back to my smash repairer and i'll get a solicitor on to them.

Do you think im silly, am i doing the right thing...
but seriouslly how am i ment to replace it for $14k, but i don't want to get it fixed.
